Terms & Conditions
These terms govern your use of the Honour Guard website and, where engaged, our advisory services. Please read them before requesting an engagement.
1. About this document
Honour Guard (“we”,“us”) is an independent security consultancy (ABN 32 413 269 037), Master Licence MA 000111477, NSW. References to “you” mean the person or organisation using this website or engaging our services.
2. Nature of our services (no outcome guarantee)
Our services are advisory: risk assessments, security audits, physical and digital security planning, policy and compliance support, and ongoing advisory. Because security outcomes depend on circumstances beyond our control, we do not guarantee that a threat will not occur, and we do not warrant any specific outcome. Our deliverables reflect professional opinion at the date of assessment.
3. Engagement & scope
Engagements are formed by a written proposal and acceptance (email is sufficient). The scope, fees and deliverables are set out in the proposal. Any work outside that scope requires a separate written agreement.
4. Fees & payment
Fees are in Australian dollars (AUD) and stated in the proposal. Invoices are payable as set out in the proposal (default: 30 days), unless otherwise agreed. Work does not commence until any agreed deposit is received.
5. Intellectual property
Deliverables we create for you (assessments, reports, policies) are for your internal use in connection with the engagement. We retain ownership of our underlying methodologies and templates. No licence or resale of our work to third parties is granted.
6. Confidentiality
Both parties agree to keep confidential all information exchanged in connection with an engagement, including any security vulnerabilities or weaknesses identified. This obligation continues after the engagement ends.
7. Liability & limitation
To the maximum extent permitted by law and the Australian Consumer Law, our liability arising from an engagement is limited to the fees paid for that engagement. Nothing in these terms excludes or limits any right you have under the Australian Consumer Law, and if any term is void to that extent it is read down.
8. Cancellation & termination
Either party may terminate an engagement with written notice. For work already performed, you will pay for work completed at the agreed rate to the date of termination, unless the termination is due to our default.
9. Governing law & disputes
These terms are governed by the laws of New South Wales, Australia. Disputes will first be raised in writing and, failing resolution, will be resolved in the courts of New South Wales.
